Working time infringements

On this page you can choose whether to display working time infringements on Scania Tachograph Portal. You can also adjust how working time infringements are displayed, in order to reflect national legislation and employer agreements.

What are working time infringements?

Working time infringements are infringements of the EU road transport working time directive 2002/15/EC. This directive determines when and for how long people working in transport may work. Among other things, it determines the maximum working time per week, the average weekly working time for a reference period, and how often breaks must be taken.

If you choose to display working time infringements on Scania Tachograph Portal, you will see the working time infringements in a separate column on all pages on the portal that display infringements, for example the Process infringements page. You will also see working time infringements in the Follow-up letter. There are also reports on the Analysis > Driver page which contain working time infringements.

If you choose to show working time infringements, you will also be able to report statutory days not worked. These are days not worked which the driver has a right to take according to legislation. In order to avoid these types of days being used to reduce a driver’s average weekly working time, these days are counted as a neutral working day in the statistics.

NOTE: The possibility to report statutory days is only available for some markets.

Working time infringements are different from driving time infringements, which are infringements of the EU regulation on driving times and rest periods, (EC) No. 561/2006. Both these types of infringement are displayed separately in all tables if you choose to display working time infringements. If you do not choose to display working time infringements, only driving time infringements will be displayed.

According to the directive, which rules apply?

Maximum working time per week

Work may not be carried out for longer than 60 hours per week. This applies to all types of work. This limit must not be exceeded under any circumstances.

Average working time for a reference period

The average working time may not exceed 48 hours a week. A driver working over 48 hours one week must therefore compensate for this by working for less than 48 hours another week. Calculation of average working time may vary depending on national legislation and employer agreements. You can set what is applicable to your company on this page.

Breaks

Work may not be carried out for longer than 6 hours continuously without a break. If the work lasts for between 6 and 9 hours, the work must be interrupted by breaks of at least 30 minutes. If the work lasts for longer than 9 hours, there must be breaks of at least 45 minutes. These breaks can be divided into multiple periods of at least 15 minutes, or be taken as a continuous period.

Maximum working time for night work

If you carry out night work, the total working time for a 24 hour period may not exceed 10 hours. Night work is work carried out during a period of at least 4 hours, determined by national legislation, between 0:00 and 7:00.The 10 hour limit and when the 4 hour period between 0:00 and 7:00 occurs may vary depending on national legislation and employer agreements. You can set what is applicable to your company on this page.

Display working time infringements

  1. Select the Yes option from the list next to Display working time infringements.
  2. Click Save. Wait a moment while the system recalculates the data. Note: The settings do not just apply to new data which has been uploaded. All data will be recalculated.  Therefore, new historical infringements may come to light.
  • Click Cancel to continue without saving the changes.

Make settings for average weekly working time

  1. Choose between the Rolling and Fixed options next to Type of reference period.
  • Rolling: The average working time is calculated continuously every week. The reference period for which the value is calculated consists of the most recent weeks, depending on the length of the reference period you have selected. Therefore, every week the reference period is moved forward a week.
  • Fixed: The average working time is calculated for preset reference periods starting from a certain date. Starting with this date, the weeks are divided into reference periods of the length selected. The first reference period starts on the selected start date and the next one starts the selected number of weeks later.
  1. At Length of reference period select a time period of between 16 and 26 weeks. This is the period over which the average working time will be calculated to see whether the driver is complying with the statutory limit for this period. How long this period should be, is governed by your national legislation and your employer agreements.
  2. Select a start date next to Start date if you have chosen fixed reference periods. This date will be used as a starting point when the weeks are divided into reference periods of the selected length.
  3. Click Save.
  • Click Cancel to continue without saving the changes.

Set night work

  1. Select the Yes option from the list next to Display night work infringements. If you select this option, night work infringements will be displayed on the portal. You can subsequently set how night work is calculated.
  2. At Time period considered to be night select the times to be regarded as night work. If work is carried out during this period, the total working time for the 24 hour period may not exceed the limit for maximum working time involving night work. When this period occurs is governed by your national legislation and your employer agreements.
  3. Next to Maximum working time as night work, select the maximum number of working hours to be carried out in the 24 hour period if night work has been performed. How long this period should be, is governed by your national legislation and your employer agreements.
  4. Click Save.
  • Click Cancel to continue without saving the changes.

Select time zone

Select which time zone the times on the portal should be in. The time zone selected will apply to all time details on the portal and in the reports.

  1. Select a time zone in the list beside Time zone.
  • If you are unsure of which time zone you should set, you can check the time zone being used by your computer by clicking the clock in the activity field and then clicking Change date and time settings. You can see here which time zone the computer is using.
  1. Click Save. Wait a moment while the system recalculates the data.
  • Click Cancel to continue without saving the changes.

Note: It is also possible to change time zone on the Settings > General page. If you make the change on one page, the change will also be reflected on other pages.
